Since he had situational authority, he can counsel you. However, if he's trying to make a big deal about it after the fact (and you have the backing of your NCO) then you can probably appeal the issue to your Platoon Sergeant. He may even send you to the Platoon Leader to plead your case, but I don't expect it to go anywhere beyond that. If the counseling is unwarranted and just a case that this other person brought up out of spite, it could have repercussions for them for acting unprofessionally.
